Horse Requirements

  • Horses must meet the minimum requirements to be declared adequate for sale.
  • Horses that are not adequate for sale include:
    ○ Horses with very poor body condition
    ○ Horses suffering from weakness due to emaciation, injury and/or disease
  • Horses deemed inadequate for sale will be refused entry. The vendor will be given an explanation for the reasons of refusal. The vendor’s details will be retained and referred to an appropriate body for follow up on the welfare of the horse.
  • Alternatively the vendor may choose to surrender the horse (without cost) to one of the animal welfare authorities attending the auction, and there will be no further follow up with the vendor.
  • Horses refused entry (either taken back by the vendor or accepted for surrender) will be required to be removed from the auction premises and provided with the immediate required care.
  • The following behavioural and medical conditions must be disclosed by the vendor to Pakenham Horse Auctions prior to the sale and these facts will be disclosed at the time of sale:
    ○ Any horse showing any stereotypic behaviour (e.g. cribbing, windsucking)
    ○ Symptoms of wobbler disease or other respiratory diseases (e.g. roaring).
    ○ Any rig horse or horse showing a visible deformity of the genitalia
  • If the vendor fails to disclose one of the conditions, and the purchaser (at his expense) provides certified written evidence of the condition, by a veterinarian, within 7 days of the auction, the purchaser may then cancel the sale by notice in writing to Pakenham Horse Auctions and be entitled to a refund of purchase price paid.
  • Should an independent veterinarian deny the existence of the above mentioned
  • conditions in the horse, the purchaser shall not have the right to cancel the trade.
  • Pakenham Horse Auctions will not tolerate any mistreatment of any livestock.
  • Individuals found accountable for mistreatment will be referred to the relevant authorities and banned from attending any future Pakenham Horse Auction events.

Drug policy

  • No prohibited substance is to be administered to the horse in the time before the sale such that, any ingredient or metabolites of it is present in the horse (blood, saliva and/or urine samples).
  • “Prohibited substances” include local anaesthetics, tranquilizers, depressants, stimulants, psychotropic (mood and/or behaviour altering) substances, or drugs which may affect the horse’s performance (unless accompanied by a veterinary certificate).
  • Veterinary certificates must be dated within 7 days of the auction and include the following: 
    ○ The horse is adequate for sale 
    ○ Any drug/s administered and the reason the drug/s has/have been given.
  • The purchaser (at his expense) can request a test for prohibited substances at the fall of the auctioneer’s hammer. If the horse returns a positive swab to any prohibited substance, the sale may be cancelled.
  • If a prohibited substances test is requested at the fall of the auctioneer’s hammer, the purchaser must: 
    ○ Inform Pakenham Horse Auctions of the horse’s location 
    ○ Ensure the horse is maintained in good health and condition, which includes protection from damage and injury 
    ○ Not subject the horse to any form of surgery 
    ○ Not lease, sell or create any security interest in the horse 
    ○ Not do prejudicial act/s to the interests of the vendor and Pakenham Horse Auctions
  • The blood test is to be done onsite. If in the event, the analysis has not been carried out, or the sample results are not conveyed to Pakenham Horse Auctions within 7 days of the sale, the purchaser will not have the right to cancel the sale.
  • If the horse returns a positive swab, the vendor will be banned from entering a horse into future Pakenham Horse Auctions.
  • If any horse returns a positive swab that have not been disclosed by the vendor presale, the purchaser will be entitled to a refund of purchase price paid and the vendor will forfeit any right of vendorship for such horse/s in favour of Pakenham Horse Auctions. Those horses will then be sold at the next Pakenham Horse Auction with disclosure being made at such a sale.

Pakenham Horse Auction’s Position

  • Pakenham Horse Auctions will not be liable for any loss, damage or personal injury which is suffered or sustained to horses, people, animals or property, including those caused by negligence or willful misconduct, during or after the sale.
  • Pakenham Horse Auctions is not responsible for the reliability, accuracy or interpretation of the horse’s information provided by the vendor. Purchasers should make their own enquiries regarding the legitimacy and accuracy of the given information.
